The number of countries that recognize same sex marriage continues to increase. Foreign same sex marriages are recognized in Washington State in the same way as heterosexual marriages. The problem can arise when one goes to a foreign country, separates from one’s spouse, and that country may not recognize your marriage. Depending upon the country in question that can lead to less advantageous financial and other results for you. Your relationship may even be illegal in that other country. Your position could possibly be bettered with a prenuptial and/or cohabitation agreement but again that depends upon the position of the foreign country in relation to same sex relationships.
Much the same issues can arise in cohabitation without marriage. Different countries have different rules. To the extent possible it is advisable to plan ahead before one leaves one country for another.
